What is certain is they are spending millions if not tens of millions of dollars on political election style ads starting 9 months before an election is due and outside the Elections Canada pre-election regulated period.

Elections Canada is responsible for pre-election and election periods.

Any 3rd Party such as the companies above would be responsible to register with Elections Canada and file appropriate reports if they were collecting and spending money within the 2 periods aforementioned.

What is a pre-election period?

Pre-election period starts on June 30

Provisions recently added to the Canada Elections Act have introduced a new regulated period, the pre-election period, which starts on June 30, 2019, and ends on the day before the general election is called. During this period, registered parties and registered third parties are subject to spending limits and reporting obligations for certain regulated activities. In addition, the new provisions require online platforms that meet a certain monthly visitor threshold to share information with regards to political ads.

This is important as there is no pre-election period if there is a snap or earlier election called as the pre-election presumes it will be held in October every 4 years.

Who is a third party? When do they register?

Outside the pre-election and election period – Elections Canada does not regulate or prescribe what these 3rd Parties may do and does not require reporting.

In essence where the money comes from remains dark and has no limits on amounts.

Election 2021 called on August 15, 2021

This was a snap election call 2 years ahead of schedule. Ironically however – months ahead of the actual election date Protecting Canada Project started spending millions of dollars on political election style ads aimed at discrediting Erin O’Toole that were very similar in nature and message to the ads aimed at Pierre Poilievre now being run by Protecting Canada.

In 2019 Justin Trudeau’s Liberals were elected with a minority government. The polls for the Liberals and Conservatives were competitive during 2020. In early 2021 Protecting Canada Project started their anti-O’Toole messaging. This served to boost Liberal polls over the coming months. As all of this was done outside the pre-election period – the identity of donors and the amounts contributed –  were unknown. As the 2021 August election call was outside the pre-election period – there was no need for registry with Elections Canada.

When the election was called – it became an election period – wherein Protecting Canada Project would have had to register with Elections Canada and file reports outlining information on donors and spending amounts. The Protecting Canada Project did not register with Elections Canada and stopped political activities. During the election month without their ads –  the polls tightened and the Liberal government was returned with a minority.

As a Federal not-for-profit “soliciting” company – was by law – to file financials under the not for profit Corporations Act. A portion of this financial information would be available to the public under the Act and would be under a public registry. The company dissolved in 2022 having never filed financials.

This was confirmed with Corporations Canada by telephone.

When asked why Corporations Canada did not demand the financials – the answer was – there is a grace period and they dissolved before the grace period was up – so we didn’t get them.

When asked who was responsible from Corporations Canada to follow-up and get the overdue financials the answer was the Compliance division.

When asked to direct the call to the Compliance Division – answer was they don’t answer phones re inquiries.

To put this in perspective a company can set-up as a Canadian not-for-profit – solicit money, spend the money whatever way they want over a less than 2-year period – file for dissolution and not have to follow reporting laws.

Corporations Canada has the authority to block the dissolution and enforce compliance but did not exercise that authority and granted dissolution.

Canadians contribute to not for profit companies every day. They cannot be certain of legitimacy under the weak scrutiny by Corporations Canada under Innovation, Science and Economic Development Canada.

The situation was made worse by Protecting Canada Project by its very concealing nature. The public did not have a phone #, an in-person office or location. They cannot see if the donors were foreign or Canadian, Corporate, Union, other organizations with government funding.

Present Day

Liberals are facing non-confidence votes fall and winter 2024 into early 2025. Polling territory very low – as low as possibly losing official party status in HOC.

Once again, we are outside the pre-election period that would occur in June of this year for a fixed election date in October.

Almost identical to the previous corporation, they start running ads against the Leader of the Opposition this time it’s Poilievre and Trump

Instead of O’Toole and Kenney and Ford.

The time frame is well outside the next fixed election date as was 2021 and the ads are arguably impacting polls.

In Canada only natural people can contribute to a federal political party. No Union or Corporate donations allowed.

Corporations like Protecting Canada can receive contributions from anywhere – anyone – any Corporation or Union and use those funds for political attack ads without scrutiny or rules – as long as they fall outside the pre-election or election periods.

Protecting Canada like Protecting Canada project is particularly evasive when it comes to who they are – how to reach them – no in-person office. There are many small not for profits in Canada that have limited resources and cannot afford offices, dedicated media personal, or lengthy reporting. These 2 corporations are collecting millions of dollars over short periods and claim they represent ordinary Canadians.

Their ads are deceptive through omission while their stated claims are to inform Canadians.

Serious questions remain and we will ask them.

  1. Request to Elections Canada to determine if these companies were green-lit to early elections,
  2. Whether the ads meet https://adstandards.ca/about/ – we will file a complaint,
  3. Request legislative change for unaccountable political companies that can be used for election interference or inappropriate influence that can harm our democracy,
  4. That companies that are proxy political arms of political parties not be permitted to incorporate under not for profit corporations.
  5. Complaint to Corporations Canada.
